Agreement to These Terms
These Terms of Service (“Terms”) govern your use of the Dance Arts mobile application and website at dancearts-sdt.com, operated by Dance Arts, 2425 W. Marquette Woods Rd., Stevensville, MI 49127 (“Dance Arts,” “we,” “us”).
By creating an account or using the app or website, you agree to these Terms. If you do not agree, do not use the app or website.
Who Can Use the App
The Dance Arts app is intended for use by parents and guardians of students enrolled at Dance Arts. You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older and that you are the parent or legal guardian of any children you add to the app.
Accounts are for individual use only. You are responsible for all activity that occurs under your account.
Acceptable Use
You agree to use the app and website only for lawful purposes and in a manner consistent with the Dance Arts community. Specifically, you agree not to:
- Send harassing, threatening, abusive, defamatory, or offensive messages to instructors, staff, or administrators through the in-app messaging system.
- Use the messaging system for any purpose other than communicating with studio staff about your child’s enrollment and classes.
- Attempt to gain unauthorized access to other users’ accounts or any system connected to the app.
- Upload or transmit any content that is illegal, obscene, or harmful.
- Impersonate another person or misrepresent your identity or your relationship to any child added to the app.
Dance Arts reserves the right to remove content that violates these Terms and to suspend or terminate accounts of users who engage in prohibited conduct, including harassment of studio staff or other community members. This applies to all in-app communications.
Content You Submit
When you send messages or submit any other content through the app, you represent that you have the right to submit that content and that it does not violate anyone else’s rights.
You retain ownership of content you submit. By submitting it, you grant Dance Arts a limited license to store and display it as necessary to operate the app (for example, so your messages appear to the recipient).
App Store Terms (iOS Users)
The Dance Arts app is available on the Apple App Store. Your use of the iOS app is also subject to Apple’s standard Licensed Application End User License Agreement (EULA), which is incorporated into these Terms by reference. In any conflict between Apple’s EULA and these Terms, Apple’s EULA controls to the extent required by Apple.
Dance Arts, not Apple, is solely responsible for the Dance Arts app and its content. Apple has no obligation to provide maintenance or support for the app.
App Enrollment vs. Studio Registration
Adding a class to your child’s profile in the app organizes your schedule view and enables messaging with the instructor. It does not constitute official registration at Dance Arts. To enroll your child in a class, you must register through the Parent Portal or contact the studio directly. Class availability and scheduling are subject to change at the studio’s discretion.
Disclaimers and Limitation of Liability
The Dance Arts app and website are provided “as is” without warranty of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that all features will be available at all times.
To the fullest extent permitted by applicable law, Dance Arts is not liable for any indirect, incidental, or consequential damages arising from your use of the app or website.
Suspension and Termination
Dance Arts may suspend or terminate your account if you violate these Terms, if required by law, or if we determine that your use of the app is harmful to other users or to the studio community.
You may close your account at any time from Settings > Delete Account in the app.
Governing Law
These Terms are governed by the laws of the State of Michigan. Any disputes arising from these Terms or your use of the app shall be resolved in the courts of Berrien County, Michigan.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For significant changes, we will notify you through the app. Your continued use of the app after changes are posted constitutes your acceptance of the updated Terms.
